By accessing this website or placing an order with NEVERLOSE, you agree to these Terms of Service. If you do not agree, please do not use this site.

NEVERLOSE is an Austrian streetwear label. References to "we", "us", or "NEVERLOSE" refer to this label. "You" refers to the customer using this website.

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions at any time.

Product colours may appear slightly different on screen depending on your display settings. We do our best to represent items accurately.

NEVERLOSE releases in drops. Drop 01 is made to order: products can be ordered during the pre-order window shown on the product page (25.10.2026, 18:00 until 01.11.2026, 23:59 Vienna time) and are produced after the window closes. Join the waitlist to be notified of future drops.

All prices are displayed in Euro (€). As a small business under § 6 (1) 27 of the Austrian VAT Act (UStG), we do not charge VAT. Shipping costs are calculated at checkout.

We accept all major payment methods available through Shopify Payments. By submitting an order, you confirm that the payment details provided are valid and belong to you.

We reserve the right to cancel orders where pricing errors occur. In such cases, a full refund will be issued immediately.

Your order is accepted and the contract is concluded when you receive our order confirmation email. We may cancel an order in the case of obvious pricing errors (see section 03); any payment will then be refunded in full.

Pre-order items are shipped once production is complete. For Drop 01, orders ship in early to mid December 2026. The expected shipping time is stated on the product page before you order. If production is delayed, we will inform you by email with a new date, and you may cancel your order for a full refund.

Once shipped, delivery times depend on your location and chosen shipping method. We are not responsible for delays caused by carriers or customs.

If you are a consumer, the risk of loss or damage passes to you only when you, or a person you name, receive the goods. Lost or damaged parcels are our responsibility.

Our full return and refund policy is detailed on the Refund Policy page. By placing an order, you acknowledge and accept those terms.

All content on this website — including but not limited to the NEVERLOSE name, logo, product photography, graphics, and text — is the exclusive property of NEVERLOSE and protected by applicable intellectual property laws.

You may not reproduce, distribute, or use any content from this site for commercial purposes without our prior written consent. Personal, non-commercial use is permitted.

When using this website, you agree not to:

• Use the site for unlawful purposes or in violation of any applicable law
• Attempt to gain unauthorised access to any part of our systems
• Submit false or misleading information during checkout or account creation
• Resell items purchased from NEVERLOSE without prior written agreement

To the maximum extent permitted by Austrian law, NEVERLOSE shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or products purchased from us.

Our total liability for any claim related to a specific order shall not exceed the amount paid for that order.

Nothing in these terms limits your statutory consumer rights under EU or Austrian law.

Your use of this website is also governed by our Privacy Policy, which is incorporated into these terms by reference.

We may update these Terms of Service at any time. Changes take effect immediately upon posting to this page. Continued use of the website after changes constitutes acceptance of the revised terms.

These terms are governed by the laws of Austria. Any disputes arising from these terms or your use of this website shall be subject to the exclusive jurisdiction of the competent courts in Austria.
